Terms of use
Summary in plain language
- A parent or guardian agrees to these terms on behalf of their child; Yodelope is downloaded and set up by an adult.
- Coins are earned only by singing. There is no way to buy coins with money.
- Extra song packs, if any, are purchased by a parent through the app store, behind a parental gate.
- There are no ads, no chat, and no way for another player to contact your child.
- Refunds go through Apple or Google, per their standard policies.
Acceptance of terms
These terms govern use of the Yodelope app and the yodelope.com website, operated by Spindlecode, LLC. These terms are between you and Spindlecode, LLC. By downloading, installing, or using Yodelope, you agree to these terms on behalf of yourself and any child you allow to use the app.
Who is agreeing
Yodelope is directed at children, but this agreement is with the adult who downloads and sets up the app — a parent or legal guardian. Children do not have the legal capacity to agree to these terms, and nothing in the app asks a child to do so.
License to use the app
Subject to these terms, Spindlecode grants you a limited, non-exclusive, non-transferable, revocable license to install and use Yodelope on devices you own or control, for personal, non-commercial, household use. This license does not include any right to copy, modify, reverse engineer, redistribute, or create derivative works from the app, except to the extent applicable law gives you that right despite this restriction.
No ads, no chat, no purchasable coins
Yodelope does not:
- Show advertising of any kind.
- Include chat, messaging, or any way for one player to contact another.
- Let coins be purchased with real money. Coins are earned only by singing.
- Use randomized rewards, loot boxes, or gacha mechanics.
- Use streaks, daily-login rewards, or re-engagement timers.
This is a structural commitment described in our own architecture documentation, not just a policy statement — see /for-parents for more detail.
Song packs, purchases, and refunds
The base app is free to download and includes a starter set of songs. Additional song packs are available as one-time purchases made by a parent through the App Store or Google Play, behind the parental gate. There are no subscriptions and no ads.
Coins are earned in-game only and can never be purchased. When a child doesn't have enough coins for something, the app sends them back to singing, not to a store.
Additional song packs can only be purchased by a parent — every purchase flow sits behind a parental gate (a press-and-hold, drag-to-target gesture; not a puzzle a child could solve). All payments are processed by the Apple App Store or Google Play, not by Spindlecode directly; we never see your payment card details.
Refunds are handled through Apple's or Google's own refund process and policies, since they process the payment. Spindlecode does not process refunds directly and cannot override a store's decision.
Age rating and app-store controls
Yodelope is designed and rated for children under 13. Yodelope has not yet been submitted to the App Store or Google Play. Its age rating and Texas app-store age category will be published here when assigned. The app stores handle age verification and parental-approval signals at the platform level; see /for-parents for what that means in practice.
Intellectual property
Yodelope, the Yodelope name and logo, Yoli, and the other characters are trademarks and copyrighted works of Spindlecode, LLC. Third-party open-source components used in the app are licensed as described at /licenses. "Yodelope" is used as a trademark (™) pending registration; we do not use the registered-trademark symbol (®) until registration issues.
Acceptable use
You agree not to use Yodelope to violate any law, to attempt to access parts of the app or its infrastructure you're not authorized to access, or to interfere with the app's operation. Because Yodelope has no user accounts, chat, or shared content between players, most of the conduct rules that apply to social apps simply don't have anything to attach to here.
Disclaimers and limitation of liability
THE APP AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. Spindlecode, LLC does not warrant that the app will be uninterrupted, error-free, or secure, or that any defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SPINDLECODE, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF YODELOPE, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF SPINDLECODE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SPINDLECODE'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO YODELOPE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP OR ANY SONG PACKS IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50.
Nothing in this section limits the specific commitments about children's data made in our Privacy Notice.
Termination
You may stop using Yodelope at any time by uninstalling the app. Because Yodelope has no server-side account, uninstalling the app ends the license. Spindlecode may revoke access to purchased content only for breach of these terms; purchases are otherwise permanent to the store account they were made on. We may suspend or terminate access to the app for a violation of these terms.
Governing law and disputes
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
You and Spindlecode, LLC agree that any dispute, claim, or controversy arising out of or relating to these terms or Yodelope (a "Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as set forth below. The arbitration will be seated in Austin, Texas, or, at your election, conducted by telephone, video, or written submission. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this provision.
Class-action waiver. You and Spindlecode, LLC agree that each may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Exceptions. Either party may (a) bring a qualifying claim in small-claims court, so long as the matter remains in that court and is brought on an individual (non-class) basis; and (b) seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights. Claims for public injunctive relief are not waived to the extent such waiver is unenforceable under applicable law.
SB 2420 note. Texas SB 2420 creates a private right of action for app-store-accountability obligations specifically. This arbitration agreement does not waive any right that applicable law provides cannot be waived.
30-day opt-out. You may opt out of this arbitration and class-action waiver section by emailing contact@yodelope.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these terms. If you opt out, this section does not apply to you, but the rest of the terms (including Governing Law) does.
Forum if arbitration does not apply. If the arbitration agreement is found unenforceable as to any Dispute, or if you validly opt out, that Dispute will be brought exclusively in the state or federal courts located in Travis County, Texas, and you and Spindlecode, LLC consent to the personal jurisdiction of those courts.
Changes to these terms
If we make a material change to these terms, we'll update the "Last updated" date above. Continued use of the app after a change means you accept the updated terms.
